What the 7-minute rule means
When a time clock rounds to the nearest quarter hour, each punch moves to the closest :00, :15, :30 or :45. The halfway point is 7½ minutes, so:
- 1 to 7 minutes after a quarter hour round down: 8:07 becomes 8:00.
- 8 to 14 minutes after a quarter hour round up: 8:08 becomes 8:15.
| Punch | Rounds to | Punch | Rounds to |
|---|---|---|---|
| 8:00 – 8:07 | 8:00 | 8:30 – 8:37 | 8:30 |
| 8:08 – 8:22 | 8:15 | 8:38 – 8:52 | 8:45 |
| 8:23 – 8:37 | 8:30 | 8:53 – 9:07 | 9:00 |
Tenth-of-an-hour rounding works the same way with 6-minute blocks (1–2 minutes round down, 3–5 round up), and 5-minute rounding with 5-minute blocks (1–2 down, 3–4 up).
Is time clock rounding legal?
Under federal rules, yes — if it's neutral. The Department of Labor accepts recording start and stop times to the nearest 5 minutes, tenth of an hour or quarter hour, as long as it averages out so employees are paid for all the time they actually work over a period of time. A system that only ever rounds in the employer's favor — down at clock-in for early arrivals but never up — doesn't meet that test.
Some states are stricter. In California, for example, courts have said employers can't round meal-period punches and have questioned rounding where exact times are recorded anyway. If your hours look consistently short, compare the exact times with what you were paid.
Worked example: clock in 8:07 AM, clock out 4:53 PM, quarter-hour rounding
- 8:07 rounds down to 8:00; 4:53 rounds up to 5:00.
- Exact time: 8 hours 46 minutes. Rounded time: 9 hours — 14 minutes in the employee's favor this time.
- Clocking in at 8:08 and out at 4:52 would round the other way, to 8:15 and 4:45: 8 hours 30 minutes for 8 hours 44 minutes worked.
Frequently asked questions
Does 8 minutes late round to 15 minutes late?
With quarter-hour rounding, yes: a punch 8 minutes past the quarter hour rounds up to the next quarter. Many employers also have separate attendance rules about lateness.
Should my employer round or use exact minutes?
Either is allowed under federal rules if rounding is neutral. Exact minutes avoid disputes, and most modern time-tracking systems record them.
Does rounding apply to breaks?
It can, but in some states — including California for meal periods — rounding break punches has been ruled out. Check your state's rules.
